EUDR

PLEASE NOTE: The EU Deforestation Regulation (EUDR) implementation is postponed to December 30, 2025!

WHAT IS EUDR?

The regulation aims to prevent the import and sale of products on the EU market that contribute to deforestation. This includes commodities such as soy, palm oil, timber, cattle, coffee, cocoa, and rubber. Companies wishing to import or sell these products in the EU must provide proof that they are not linked to deforestation after the cutoff date of December 31, 2020.

To be placed on the European Union market, products and raw materials must meet the following criteria:

  • Deforestation-free: They must not originate from deforested land or land that has undergone forest degradation after the cutoff date of December 31, 2020
  • Legally produced: They must comply with all applicable regulations and legislation in the country of origin.
  • Traceability through due diligence: A due diligence statement must include geographical data for all plots where coffee has been cultivated. For plots larger than 4 hectares, polygons with sufficient latitude and longitude points must be provided. For plots smaller than 4 hectares, a single latitude and longitude point is sufficient.

WHAT FOR?

Deforestation and forest degradation are among the main causes of climate change and biodiversity loss – the two biggest global environmental crises of our time.

WHEN DOES THE REGULATION COME INTO EFFECT?
The regulation will come into effect on December 30, 2025, and on June 30, 2026, for micro and small businesses.

WHAT IS OUR ROLE AS TOUTON SPECIALTIES?
We, as the Touton group, are firmly committed to supporting the implementation of the EUDR as part of its fight against deforestation. The key elements of the EUDR are risk assessment and the adoption of preventive and remedial measures to achieve a zero or negligible deforestation risk level, allowing products to be exported to the European Union market.

Touton is actively preparing for the entry into force of the EUDR, which will have an impact on day-to-day cocoa and coffee operations, notably by setting up a cross-functional working group:

  • by defining roles and responsibilities for implementing and complying with requirements
  • by combining the expertise of different departments: IT, back office, sustainable development, legal and compliance, audit, etc.;
  • Involving not only of our head office, but also of our subsidiaries and suppliers in producer countries
  • Developing a reliable and verifiable internal methodology for the risk assessment matrix around three themes: traceability, deforestation, and legality

GETTING READY FOR EUDR!

IMPORTERS

Companies that are not SMEs and wish to import the listed raw materials into the EU must fulfill the following obligations:

  • Collect geolocation data of the land where the coffee was produced (polygon or GPS point) for each individual lot brought to market.
  • Conduct a risk assessment that includes legality checks and the protection of indigenous populations.
  • Implement mitigation measures to ensure that all identified risks are reduced to a negligible level.

ROASTERS AND RETAILERS

As a roaster, it is now more crucial than ever to choose reliable and trustworthy trading partners, like Touton Specialties, who can provide support and ensure you're fully covered.

After companies have submitted their due diligence statements in the EU Information System (IS), market participants further down the supply chain (including roasters) will be provided with reference numbers for each lot, which refer to the due diligence conducted. However, they are required to verify that due diligence has been carried out, and they remain legally responsible in the event of a breach of the regulation.
